Terms and Conditions of E-services:
Terms and Conditions for Subscribing to the Electronic Channels of the Bank of Jordan Syria
* These terms and conditions shall be applicable to the relationship held between the Bank of Jordan Syria Plc (the bank) and any of the bank’s customers (the Customer) who shall submit an application for subscribing to the electronic channels to be provided with the services offered through the same, any channel and/or potential service that the bank may decide to add thereafter. In fact, these terms and conditions shall form an integral part for the subscription’s application to the electronic channels signed by the customer with any of the bank’s branches. However, and by signing to these terms and conditions, the customer acknowledges that he understands them thoroughly and approves the same without prejudice to the bank’s right to cause any alteration to be effected to their contents or any part thereof at any time and to consider the amendment as being effective as from the date on which the customer shall be by notified by a letter addressed to him at the address shown in the subscription’s application or through the electronic channels.

* The following words and expressions shall have the meanings assigned to them unless otherwise required by the context:
The bank The Bank of Jordan Syria Plc or any of its branches.
The customer The account and/or accounts owner whose subscription to the electronic channels has been approved and who shall be fully responsible for using any of them and benefiting from the services offered through the same.
A Working Day The bank’s official working hours set for dealing with public as from 8:30 a.m. till 3:00 p.m. noon or otherwise as may be determined the Central Bank excluding the holidays and official days.
The Electronic Channel The electronic channels offered by the bank that shall include: IVR, the Internet banking, the mobile banking and the SMS) in addition to any channel and/or channels that the bank may decide to add in the future.
The service The services approved by the bank to be offered to the customer through the electronic channels accessed to the customer’s accounts held with the bank.
Customer’s account The accounts held by the customer with the bank being related to the applications of the electronic channels.
ID Code The user’s identification code used to access the electronic channel which shall be given to the customer by the bank.
Login Password The number issued by the bank to the customer to be able to access the electronic channels which shall be changed by the customer immediately after his first access to the electronic channel. Further, the customer can change it whenever he desires or according to the requirements set for using the electronic channels.
Transaction Password The number issued by the bank to the subscriber to the electronic channels that shall be used in particular for the transfers and money orders. In fact, the customer shall change the said number immediately after his first access to the electronic channels. Further, the customer can change it whenever he desires or according to the requirements set for using the electronic channels.
Interests, commissions and expenses The same includes the several interests, commissions, expenses, duty stamps, mail charges, telex, telephone, fax, transportation fees, exchange difference and other commissions in addition to the collection expenses, attorney fees and experience fees or any fees that may be incurred by the bank resulting from the customer’s subscription and using of the electronic channel.
The E-mail For the purposes of performing this agreement, then the same shall mean the electronic mail service through which the messages shall be exchanged between the bank and the customer through the banking service channel via the Internet exclusively.
The electronic money transfer The same is related to effecting any money transfer operations whether between the customer’s accounts, for settling the general services bills, effecting a transfer for the accounts of other customers held with the bank, a transfer for other parties, other banks and/or for recharging the cards or any other future services that may be of a direct effect on the customer’s account and financial transactions.
  1. The preamble shall be considered an integral part of these terms and conditions to be read with the same as one set.
  2. The customer does hereby acknowledge and approve any entries that may be effected by the bank for any sums resulted from the subscription to the electronic channel and utilizing from the services offered through the said electronic channel. Further, and without having to refer to the customer or otherwise to be in need for a subsequent authorization, the bank shall be entitled to debit the account of the customer with all the interests, commissions and expenses paid or born by the bank on behalf of the customer or otherwise that may result out of any transactions held between the bank and the customer. In addition, the bank may cause any of the accounts of the customer to be debited with any expenses incurred by the customer of whatever type or designation including the fees of the courts, the attorney fees and legal consultations whatever.
  3. The using of the electronic channel shall be exclusively vested upon the customer, the subscriber to the electronic channel who shall be solely liable for all the risks and/or the responsibility emanated from using the electronic channel and utilizing from the services rendered through the same.
  4. The customer shall be committed to abide by the instructions set for using the electronic channel in the manner as provided to him by the bank which matter shall be observed thoroughly upon his The customer does hereby admit his knowledge and approval that he shall adhere to any amendments, instructions and/or fees in case the same shall be published by any means whether being in writing, audio, video and/or electronic for which he shall consider the same as being effective as from the date of publishing.
  5. It is understood and well established that the login passwords and ID codes are the means to identify the customer for the bank for which any transactions effected by using the ID codes and the login passwords shall be considered as being issued by him. Accordingly, he shall solely stand liable for all the transactions effected through the electronic channels subscribed to by him by using the ID code and the login password.
  6. The secret number set for accessing and/or the secret number related to the electronic transferring and payment shall stand as the signature and admittance of the customer to the effect of approving the execution of any orders, services or transfer orders for which no challenge shall be admitted to the effect that the secret numbers would have been published and used by another party or otherwise to claim that the customer did not apply for any of the services available through the electronic channels.
  7. The customer shall be responsible for providing and maintaining the tools and software as well as all the necessary supplies for operating the electronic channel including the expenses, costs and communication charges. Further, the bank shall not bear any responsibility resulted from a default and/or defect available in the software applied by the customer, the customer’s using for any software and/or any additional tools that may cause the security and efficiency of the service to the risks or default. In addition, the bank shall bear no responsibility in case of the availability of viruses enacted in the customer’s tools that may detect his basic data and/or balances for which the customer shall solely bear all the results emanated from the same. Furthermore, the bank shall not stand liable in case of the non arrival of the messages and e-mails as well as the messages sent through the cellular phones and wireless communications in case the same shall result out of the weak wire and wireless telecommunication networks in addition to the cases in which the causes are not attributed to the bank.
  8. The customer agrees to use the electronic channel and utilize from the services rendered through the same according to the list of the fees and commissions set by the bank from time to time.
  9. The customer shall solely bear the responsibility that may incur out of debiting his account/accounts upon his using any of the electronic channels in addition to any responsibility that may emanate from any mistake resulted from transferring any sum/sums to the account of any other customer via any of the electronic channels.
  10. The customer does hereby agree that the bank shall be entitled to cease and/or cancel the service and/or the electronic channel at any time and for the period as it may deem suitable without the need for a prior notice and without stating upon the causes.
  11. In case it shall be decided to grant the electronic services to companies and/or individuals in joint accounts, then it shall be provided to have all the signatories of the company and/or the joint account attended to sign the subscription application related to the electronic channels. Further, they shall authorize any of them to use the electronic service while the ID code and the login password shall stand as their signature jointly and severally for which no challenge may be approved to the effect that the ID code and the login password has been circulated and/or negotiated by any of the partners and/or the parties to the joint accounts.
  12. The customer may request ceasing and/or canceling the electronic channel or any of the services rendered through the electronic channel pursuant to a request made in writing or an electronic one to be submitted to the bank. Further, the customer shall have the right to update some of the data related to him that may be amended via the Internet channel.
  13. The bank may abstain from effecting any transfer transactions and/or money orders for any sums in case of insufficient funds held at the customer’s account at the time of effecting the transfer to cover the value of the said transactions as well as the interests, commissions and expenses related to the same. Further, the bank shall be entitled to abstain from effecting the transfer in case of exceeding the number of the times or the maximum limit permitted for the transfer on a daily basis, ????
  14. The bank shall promptly execute the transfer and on the day set by the customer in case the transfer shall be made between the accounts of the customer or to other accounts held with the bank and within the subsequent two working days in case the transfer shall be effected to accounts held with other banks in which case the sum shall be debited on the account of the customer on the day of execution. However, the bank shall not stand liable for any delay occurred beyond its control while the customer may cancel the transfer or money order by placing a request in writing with the branch with which he deals to the effect of canceling the order provided having the bank not executed the transfer and/or money order yet.
  15. Upon ceasing and/or canceling a service and/or an electronic channel for any reason whatever, then the transfer and money orders previously demanded by the customer shall remain valid and executable on the working day set by the customer unless the customer shall request its cancellation according to the condition stated upon in the previous paragraph.
  16. All the services shall be available through the electronic channels twenty four hours all through the days of the week unless the same shall be attributed to its nature or as maybe determined by the bank to be available through the working days only including the money transfer.
  17. The customer knows and approves that promptly after his applying for the electronic money transfer service, then he shall stand as having authorized the bank to grant him the said service for which he shall adhere to its terms and conditions.
  18. In case the customer shall request checks booklet through the electronic channel then the customer shall receive the booklet from the branch with which the account of the checks booklet is opened incase of approving his request.
  19. The statement of account, including the transactions effected through the electronic channels shall be considered valid unless the bank shall receive an objection in writing or via the electronic channels within fifteen days as from the date of issuing the statement of account showing the reference number and the objected transaction otherwise the entries and records of the bank shall be considered true by virtue of the law and definite towards the customer to the effect that he has actually effected the transaction which matter shall stand as a verified and documented transaction in addition to being a definite and binding evidence that may not be challenged by the customer or otherwise objected by any means whatever.
  20. The customer acknowledges that the data produced by the computer and the other technological means whether being original or photocopied including the electronic data and voice recordings shall be considered legal proving means that are true and binding for him for which he drops his right to object or challenge the same. Further, the customer agrees to consider all the electronic records of the bank as being approved, documented and being a definite as well as a binding evidence for him to which he may not be entitled to object or challenge before any party whatever.
  21. The customer shall be committed to promptly inform the bank of the possibility of having the others accessed his account or the probability of having the others known the ID code related to him or the login password for which the customer shall be liable for all the transactions and sums transferred out of the same till the end of the working day on which the bank shall receive a notice in writing from him to that effect. Further, he authorizes the bank absolutely to adopt any measures as it may deem suitable promptly after its being notified including the ceasing of the service and/or transfers and/or the non execution of any of the orders or the instructions issued by the customer to the bank via any of the electronic channels without causing the bank to bear any responsibility.
  22. The customer shall be committed to pay any additional commission for each new login password issued upon his request in case the bank shall approve the same and according to the list of rates of the commissions and fees prevailing then.
  23. In case the customer shall request ceasing any electronic channel or any of the services rendered through the same for any reason whatever being attributed to him, then the customer shall stand liable for all the transactions and sums transferred being resulted from the using of the ID code and login passwords related to him till the end of the working day on which the bank shall receive a notification from him to that effect.
  24. The electronic channel granted to the customer shall be temporarily suspended in case of the faulty entering of the login password and/or the ID code related to the transfer transactions and the money orders for three consecutive times after which the customer shall refer to his branch and/or the concerned department to reactivate the services.
  25. The bank shall have the right the amend, alter and/or add any terms and conditions that are related to the subscription to the electronic channels and/or their using after notifying the customer in writing and/or electronically at his address/domicile held with the bank after which the amendment shall be effective unless the bank shall receive an object in writing/electronically made by the customer within the period set through the notification. Further, the customer acknowledges that the bank shall be entitled to change the software applied within the electronic channel/channels rendered without the need to the prior notification of the customer to that effect.
  26. The e-mail offered via the banking service channel through the Internet shall be the safe communication means between the bank and the customer. Further, the customer shall be deemed as having received any message, notification and/or letter addressed by the bank to the mail in addition to that the customer agrees to consider any message received by the bank through the e-mail to be considered as issued by him and binding for the same.
  27. The customer approves the measures and systems applied by the bank to document the electronic transactions effected with him and processing the data which may prove the truthfulness of the data and its being attributed to the customer including his electronic signature. In addition, the customer agrees to have the bank appointed any licensed party or otherwise that may be licensed or appointed for the purposes of the documentation.
  28. It has been agreed between the bank and the customer to carry out and effect the banking dealings mentioned through these terms and conditions via electronic means in addition to having agreed upon the application of the provisions of the Jordanian Electronic Transactions Law applicable and any amendments thereof to all the said dealings.
  29. In addition to the electronic communication via the electronic channels, then the customer declares that his appointed address shall be the address held with the bank while the customer shall be committed to report any amendment incurred by the same to bank in writing.
  30. The customer shall be entitled to terminate his subscription to the electronic channels by a notice in writing to be provided to the bank. Further, the bank may terminate the customer’s subscription at any time without the need for the customer’s approval or being previously notified and without stating upon the reasons.
  31. These terms and conditions shall be subject and interpreted pursuant to the ٍSyrian Laws applicable in the Syrian Republic. Further, the First Instant Court of Damascus shall have the jurisdiction to hear any dispute related to the interpretation and/or application of these terms and conditions while each of the bank and customer does drop its/his right related to exchanging the Notary warnings.
I have read these terms and conditions and have fully understood the provisions of the same for which I agree to abide with them and with any amendment that may occur to the same thereafter. Further, that this commitment shall stand to be irrevocable for any reason whatever.
